Terms of Service

Welcome to Apex Growth Data. By engaging our services or accessing our research products, you agree to be bound by the following Terms of Service. These terms govern the relationship between Apex Growth Data ("the Provider") and the client ("the User").

1. Service Definition

Apex Growth Data provides bespoke, manual B2B market research and data enrichment services. Our deliverables consist of hand-verified datasets based on specific criteria provided by the User. We do not provide software-as-a-service (SaaS); we provide professional intelligence services.

2. Provision of Services

• Custom Research: Each project is initialized based on a specific "Search Parameter" agreed upon via email or project brief.
• Timelines: Standard delivery time is 24 to 72 hours, depending on volume. Any delays due to complex data availability will be communicated promptly.
• Manual Verification: We use human analysts to verify data points. While we strive for 100% accuracy, the User acknowledges that data in business environments decays over time.

3. Payment Terms

Due to the customized nature of manual research, all project fees are non-refundable once the research process has commenced. Payment must be cleared according to the invoice terms (typically 100% upfront for new clients, or upon approval of the sample dataset).

4. Usage Rights & Intellectual Property

Upon full payment, the Provider grants the User a perpetual, non-exclusive license to use the delivered data for their internal sales and marketing operations. Reselling, publishing, or distributing our datasets to third parties is strictly prohibited without prior written consent.

5. Compliance & Ethics

The User is solely responsible for ensuring that their use of the provided data complies with local and international outreach laws, including but not limited to GDPR (EU), CAN-SPAM (USA), and CASL (Canada). Apex Growth Data provides the intelligence; the User is responsible for the legal execution of their communication.

6. Limitation of Liability

Apex Growth Data shall not be held liable for any loss of profits, business interruptions, or damages resulting from the User's outreach campaigns. Our total liability is limited to the amount paid by the User for the specific project in question.

7. Data Accuracy Guarantee

We guarantee that all email addresses are verified via SMTP handshake at the time of delivery. If a User reports a bounce rate higher than 5% within 7 days of delivery, we will replace the invalid records free of charge. This is the sole remedy for data inaccuracies.

8. Governing Law

These terms are governed by and construed in accordance with the laws of Poland. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Warsaw.

9. Termination

We reserve the right to refuse service to any entity that we suspect intends to use our data for illegal, unethical, or spam-related purposes.
